Current commercial lease issues

 

This webinar will focus on two current issues of importance to lawyers dealing with commercial leases, namely:

 

The RICS Code for Leasing Business Premises, 1st edition

Coming into force on 1 September 2020, this Code will replace the existing Code for Leasing Business Premises in England and Wales 2007. 

 

This Webinar will highlight the differences between the old Code and the new Code, including in particular: 

  • Although the old Code was entirely voluntary, some of the new Code provisions are mandatory for surveyors, and others constitute good practice (RICS members must justify any departure from good practice);
  • The old Code contained 10 separate provisions relating to drafting lease terms – the new Code contains 12.  There are entirely new provisions relating to the demised premises, management and operational performance, energy performance certificates and landlord’s title;
  • Substantial changes have been made to the provisions relating to:
    • Tenant break rights and options to renew;
    • Rent deposits;
    • Rent review;
    • Alienation;
    • Repair;
    • Alterations

Exercising Tenant Break Options

With so many people now working from home, many tenants are looking to reduce their leased space.  This Webinar will focus on the issues to consider when exercising a tenant break option, including: 

  • Satisfying pre-conditions
  • Timing
  • Form of break notice
  • Service of break notice
  • The registration gap
  • Lessons from the cases

Speaker: Peta Dollar has more than 25 years’ experience of practising commercial property law.  She was a Real Estate Partner at the firm now known as Dentons for 17 years and has now been a full-time freelance lecturer, trainer and writer for more than 10 years, providing training on behalf of organisations such as Central Law Training and MBL Seminars as well as in-house training for major City of London, regional and Scottish law firms, property companies and local law societies.

 

Peta is a member of the Consultation Board of Practical Law Company and the Editorial Board of Landlord and Tenant Review.  She regularly publishes articles in the Estates Gazette as well as in Landlord and Tenant Review, and has contributed a number of articles to the Property Law website at www.propertylawuk.net, for which she is a Site Editor.  Peta is the co-author of two books on the Landlord and Tenant Act 1987 and writes the Mixed Use, Easements and Lease sections of Isurv (the information resource of the RICS). Peta was a member of the judging panel for the Solicitors Journal Awards 2017 (Commercial Property Team of the Year category) and has delivered a Blundell Memorial Lecture on the subject of judicial interpretation of documents noted on public registers.
