Contract Law Update

Thursday 15th October 2020

2.00 pm - 4.00 pm - this Webinar will be delivered using Zoom Web Conferencing - would like to but unable to attend?  Not to worry, all pre-booked delegates will be given access to a recording of the webinar to watch in their own time.

Speaker: Keith Markham

SRA Competence B

Completely updated for 2020, this course is designed with the busy practitioner in mind so that you can stay up to date with recent developments without having to trawl through endless case reports. There will be a summary of key recent cases with an emphasis on reviewing case studies and drawing out a series of practical steps to be borne in mind for future use.  The implications of Covid-19 will be discussed where appropriate.

Topics will include:

  • Contract formation – can you make a contract for the sale of land via exchange of e-mails signed electronically?
  • Implied terms – application of the business efficacy and officious bystander tests in recent case law
  • Good faith – ‘relational contracts’ or implied terms tests – which is more important?
  • Force majeure – the importance of causation and foreseeability
  • Contracts (Rights of Third Parties) Act 1999 – does every document need to have the exclusion?
  • Variation of contract – can estoppel apply where a variation would otherwise be invalid?
  • Liquidated damages – what is an acceptable rate of interest?

Speaker: Keith Markham qualified as a Solicitor in 2001 and now works as a freelance training consultant. Initially working in private practice, in 2004 he moved in-house at the BGL Group, a major insurance intermediary that numbers Budget and comparethemarket.com among its brands. During his time there Keith advised extensively on all areas of data protection. He also conducted contract negotiations of a complex nature, often with major blue-chip companies. In 2007, Keith joined BPP Professional Education, one of Europe’s leading providers of professional development training. He worked there as both an in-house lawyer dealing with data protection and commercial contracts and also as a presenter of training courses before ultimately deciding to specialise in delivering training and becoming a freelance training consultant in 2009. Drawing on his considerable experience Keith has designed and delivered a wide variety of training for BPP and other providers as well as for his own clients in the commercial law field. In particular he teaches topics relating to data protection and commercial contracts to lawyers and non-lawyers alike.
